Pay reference period

    If a contract says in one part that the pay reference period will be one month(clause 3) but in another part says the pay will be fourth nightly(subject to clause 3), will the pay be monthly?

    No, your pay will be fortnightly (meaning every two weeks). The pay reference period is the period across which your working hours and pay are counted to calculate your average hourly rate when you are paid on a salary basis, and that reference period can be different from your pay period. If your salary is relatively low, then a longer reference period can be beneficial for the employer if you might be working longer some weeks than others, since that way your employer won't be violating the minimum wage laws even if your effective hourly rate for a particular week is less than minimum wage, as long as your average hourly pay over the entire month is still at least minimum wage.
