4 Year old broken xbox - rights?

    Hi there,

    I bought an Xbox series x in nov 2020 that is now switching off randomly and often.

    I read about potentially having six years warranty with a defective item, but it isn't super clear as I know 2 years is the general hard warranty in the EU.

    The below is from citizens information

    Remember, a guarantee or warranty is in addition to your statutory rights. When there is a problem with the product or service you should always raise it with the seller first. The seller is responsible for resolving the issue under consumer law.

    You are entitled to raise a problem about a product for up to 6 years from the date of buying it. This applies regardless of the terms of any guarantee or warranty.

    Making a claim using a guarantee or warranty

    If you want to make a claim using your guarantee or warranty you will usually need:

    • Proof of purchase (for example a receipt)
    • Details of what the problem is
    • A copy of the warranty or guarantee

    The Competition and Consumer Protection Commission (CCPC) has more information about guarantees and warranties.

    I bought this Xbox directly from Microsoft.

    Do I have any chance of getting it repaired by them. I did speak to one of their agents who came back and said I would need to pay for it. Anyone have any luck with getting a repair past the two years?

    You could see if its an overheating issue thats causing the power offs? There will be videos of how to do it safely without shorting or damaging anything.

    Hi Op

    You could indeed make a claim to retailer where you purchased it under consumer law. (Microsoft). But that doesn't mean you will win. if you did win what portion of the original purchase price do you think would be appropriate after 4 years of use?

    you face some obstacles. If your want to say it was not of merchantable quality because you got 4 years from it, how will you demonstrate this? will you pay for engineer report to show what the fault is? will that cost more then your potential award if you win? What % of value of the purchase price you think you would get in ideal circumstances? 10% 20%?

    How much time and effort and cost will it be to bring the case and prove your case? You know you cannot claim for your time spent filing etc.

    I would personally say a console that lasted 4 years has lasted a reasonable time. the law states up to six years, so is open to interpretation. So weigh up the potential rewards vs time and effort and cost of bringing the claim. IMO even if you win, you dont come out ahead.

    And in the defense of Microsoft and others - we (and the courts) don't know if they kept the device in an environment that guarantees longevity. A lot of consoles are put into entertainment units which really impacts the cooling ability.

    As you said 4 years is reasonable, others will get 8, 10, 12 etc. but that only lends credence that the fault wasn't there at purchase and instead is due to use, whether improper or otherwise.

    Repair replace refund ask for a repair, if it can't be repaired ask for a replacement if they can't replace only then is a refund a possible option.

    Game consoles and other electronic items are consumables in the sense of they do not have a life time guarantee, rather they have a limited life span dependable on usage and other fickle issues, I sold a PS3 on adverts and the guy came back 5 years later looking for his money back.

    Four years isn't long for a new console I would check online if it is a common issue it's a designer fault and you have a possible issue to ask for s free repair but if it is wear and tear then pay up and get it fixed as you will be covered again after the repair for a period of time.

    If you sold it privately he's not entitled to a refunf after 1 day. Never mind 5 years.

    Regarding the OP they'd have to prove where the fault lies.

    4 years is a fairly long period for an electrical device IMO, and let's be honest, none of us look after these things correctly.
