    Can house be insured if it’s going through probate which has just finished but the names have not been put on the deeds yet

    I would think that the executor should ensure the property is insured.

    Yes, the executor usually arranges or advises the existing insurer of the situation and the policy is changed into the "Reps or the Late…" instead of the deceased insureds name. A new policy maybe required even with the existing insurer because of the change of "name", depends on insurer.

    I am one of the executors on Will also the house is been left in a few siblings names but probate has gone through but the name on the deeds hasn’t yet and may take a month now ( solicitor draggging was done last July ) as I am away, and because effective nobody’s name is on deeds they won’t re insure our house even though it’s been with them a good few years and insurance is up in two weeks any ideas

    I was in a similar position and just re-insured with Zurich - there was a lot of paperwork - as in , is the house occupied, is it going to be sold etc. There are a number of Insurance companies that will insure a house in probate, but for a new policy it will be expensive.

    I don't understand why your current insurer won't quote you .

    the way I see it if something were to happen to the property while still going thru sale process, why would you have a valid claim, on what basis ? Legally you would have about as much right to claim on my property as I would see it. I can understand why you are trying to have things ready for when sale gets done, but ahead of time why would an insurer provide cover if you are not the beneficial owner? If there were a claim the insurance co will only pay out the once on say a broken door, but as not the legal, why would they entertain or even pay you? Hope this assists.

    We had a similar problem with a house where a relative went into a nursing home and had dementia. The house was empty. We explained the situation to the insurance company and because we didnt have power of attorney they wouldn't insure the house. We complained to insurance company complaints department and eventually they seen reason and gave limited insursnce on the property as it was unoccupied.

    Honestly some companies are just so awkward and difficult to deal with in the event of a death or when a person becomes incapacitated. We were told they needed to speak to the insured even though the person was in a nursing home unable to move or speak and we had documentation from doctor and solicitor to confirm this. I suspect you will be told that they need to speak to the deceased person. Common sense and compassion is not something modern business does. Raise a complaint is my advice - there is usually someone there that has common sense and will offer you a solution.

    Who is the proposer for the insurance? The siblings or the executor?

    When my father passed away his house was empty while it went through probate.

    AXA were happy to insure it, but they asked that we let them know if anything substantial was removed (beds, electronics, white goods etc).

    it’s not going through a sales process as I stated the house is not been sold it’s been divided between four people , two of them living in house

    The probate has gone through it’s that the names on the deeds will take a few more weeks,

    I was talking to a guy the other day , he has never insured his house all I’m trying to do is to have cover it’s an absolute joke,

    I’m actually already named on it while my father was alive so I could speak on his behalf, and I’m one of the sibling and executor

    seems now that my late parent name is still on the deed even though probate has finished, so there is a name on the deeds until land registry is done

    well my name was also on the insurance with my mother so I could speak on her behalf, also I am an executor on the Will, just an update there an insurance company has come back three times the price of the original first quote


    Nearly every insurance company are saying the person or persons on the deeds must be alive

    You still have not said who the proposer is.
    Who are the insurance companies telling all of this about deeds? You or a broker.

    Can u not read Claw I told you twice I am ,the proposer I’m a sibling and executor ,


    They won’t insure if the probate is finished and the name on the deeds have not been changed, especially if the last person has passed away

    You don't say in which capacity you are trying to insure, as executor or sibling. You can't insure as both. You have to be one or the other for the purpose of insurance.
    You can't leaqve it to the insurance to work it iut either.
    Given that your attitude it is not surprising that no insurance company will give you a quote.
