Notice period when still in probation

    Hi,

    Would appreciate some advice. I'm 5 months into probation & about to hand in notice. It's says it's 6 weeks in contract. Does anyone know if it's the same whilst on probation? Doesn't say it in contract so just hoping as was expecting 4 weeks!

    Any insights appreciated.

    what role is this for?

    If it some kind of senior engineer , management role then maybe you would give a few weeks notice, but I am thinking if it was a role like that then you wouldn’t need to ask the question?

    Contractual notice periods for employees can be longer than the statutory notice period, and would apply during probation as well unless the contract itself says otherwise. Practically speaking, it's not likely they'd do anything if you were to give less notice than required, as the provable quantifiable damages from your breach probably wouldn't be enough to be worth suing over, but it would likely cost you a good reference and possibly any chance of being rehired by that employer in the future.

    It’s highly unlikely that an employer would take any action if you resigned with less notice than contractually provided for.

    As for the reference, these are rarely subjective and, where provide, relate to factual content - length of service etc.
