has my son right to remove children from temporary foster care

    son working with Tusla, his two children in temporary foster care, they are being emotionally abused and threatened by the family foster carer (aunt). he has shown evidence to Tusla, they ignored, children not spoken to about this, he has a solicitor who is going to contest this order next month, however the fosterer is not handing the children over for approved visitation, can my son take the children and not return them. if he does they will be living in a safe and loving environment, kids social worker recommending they live with dad, Tusla not want to work with him or believe him. have they the legal right to remove the children from his home if he refuses to hand them back to the foster family.

    The children are in state care so he cannot take them away from that, even if he feels they are not being cared for appropriately by their foster carer. Tusla are acting in loco- parentis while a care order is in place. The children's social worker is from Tusla so it is unclear why you are saying Tusla aren't working with him but the child's social worker agrees they should be with him. If he is the non- custodial parent,why was he not given the opportunity to provide full time care for them? If the children are in temporary care it is likely they are on a voluntary care order, these are usually signed for 28 days at a time but can be agreed for longer. It is all case specific. If the social workers agree that they should be with their dad then is there a reunification plan in process?
