Planning permission after a grant of retention?

    Hello. Just looking for some information about planning permission. We recently bought a house that has been substantially extended. The previous owners got a grant of retention from the council before the sale went through, because the existing extension is a little bit more than 40. Does that 'reset' the planning permission requirements to the 40m squared, or will we now be required to get full PP for any new/additional extension?

    Retention or no retention, you will need planning permission for any new/additional extension. To an existing house, you only have one 40m.sq. exemption, in total, for extensions - i.e. you can't keep adding extensions, at separate times, as exempt development.

    That's the info I was after.

    I just wasn't sure if the plans being 'on record' so to speak sort of reset the allowances. We'll contact the solicitor so.

    Relevant part of the regulations, for completeness.

    …the floor area of any such extension, taken together with the floor area of any previous extension or extensions constructed or erected after 1 October 1964, including those for which planning permission has been obtained, shall not exceed 40 square metres.
