    Morning all, seems alot of this type of FCPNs being issued according to RSA statistics, what does a Garda constitute to issue ticket for this offence? seems abit vague

    Can cover everything from something that's borderline but challengeable as dangerous driving down to lane hogging or going excessively slowly.

    Lad I worked with got it for doing ~65km/h in the outer lane of the N2 between Finglas and the M2; no extraneous circumstances like visibility/weather going on - he was just a very slow driver.

    Driving without reasonable consideration could be revving a car loudly,not idicating at a roundabout , driving too slow and similar offences. Basically its doing something to annoy other road users.

    The offence involves driving a vehicle in a public place without reasonable consideration for other persons using the place. Which means (a) there have to be other persons in the vicinity, and (b) your manner of driving must inconvenience them, and (c) this must be unreasonable — e.g. if you have a good reason for driving very slowly or coming to a sudden stop, no offence is committed, even if other drivers are inconvenienced. But if you do it arbitrarily or capriciously or for a bad reason, you may be guilty of the offence.

    It's a catch-all offence for bad driving that wouldn't rise to the level of careless driving or worse. It was added to the 1961 act as an afterthought in 1968, probably because District Court judges considered the bar for careless driving was too high to convict someone for basically driving like a selfish pr1ck.

    Something that doesn't meet the criteria for careless driving but has no set FCN such as speeding, breaking red lights, being on the phone etc.

    Some examples from my own POV just today

    • hogging the outside lane at an unreasonable speed
    • driving too close to a cyclist
    • eating a sandwich while driving
    • accelerating wildly to overtake someone because they slowed down a bit to double take you eating a sandwich (with 2 hands) from their rearview mirror
    • entering a roundabout in the wrong lane and then trying to get back in to lane to get off the roundabout but blocking everyone behind you
    • crossing the solid white line on a slip road merge about 50m before the broken line cos u have a huge truck and I won't win that fight.
