New build roof issues

In a new build for just over a year. This morning a number of slates came off and peppered the cars below, smashing windscreens and damaging bodywork. The roof looks distorted now on one side, like it was nearly going to come off.

Currently in touch with Homebond who are looking at the roof but said the cars are a matter for car insurance.

Is that really the case, that it's hard luck about the cars and we just lose no claims on both cars to get them fixed? Or should we be getting a solicitor and looking at the developer?
