MIBI - court case

    My solicitor advised to go to court against the driver and MIBI.

    I was a passenger of his vehicle on the day when he caused a car accident, due which I have serious injuries.

    The problem is that he doesn't live anymore in the apartment I know the address of (lease is still on his and his sister name, she still lives there).

    What happens if he fails to appear in court? Can the process be delayed?

    Has anyone been in court against MIBI and other driver? Do I need to be there or could I give my statement outside of the court room? What I mean, I would rather avoid a contact with him, he is know from being aggressive.

    If I got answers to these questions from him, I wouldn't ask here.

    He is good, but very busy, and to all these questions he said to not worry, all will be fine.

    Yeah, I wish my bank account could say the same after paying for all appointments and then surgery and physio 🤣

    If you are paying a solicitor you should be sending them these questions because it sounds like you don't have any idea what to expect. Has the matter been set down for trial? What happend in the PIAB stage?


    You do not give a statement in court you will have to go into the witness box while your solicitor or barrister asks you questions and then the Defendants will have an opportunity to cross examine you.

    It's unusual to sue MIBI if driver is known, did he not have insurance?

    I have asked him these questions, usually he says all will be fine or he is very busy.


    My case at final stage and is now with PIAB but more likely we will need to go to court, as PIAB doctor in his report said that I have a soft tissue strain and there is nothing wrong with me. I'm awaiting for 1st surgery of maybe 2-3 (in best case scenario so the compensation that PIAB might offer me for soft tissue strain will not cover what I have paid as far + time out of work after surgery and physiotherapy, and that's without future surgeries.

    Solicitor said to get a letter from my neurosurgeon and maybe another one to prove my injuries in court.

    No idea why PIAB doctor gave this opinion.


    Driver didn't have an insurance on the accident day, that's why we need to sue him and MIBI.
