Getting video removed off social media

    hello,

    My partner works for a nationwide pharmacist chain, which has in the last months been the subject of protests by 'activists' - handing in word salad 'legal' documents' , protesting about Covid vacs , general conspiracy theories etc) , and general low level harrassment. This in itself is not an issue - they are well used to dealing with difficult people on occasion.

    However, several videos were made and livestreamed onto facebook and elsewhere during these protests, and are still visible on some of these activist accounts. These videos have attractted some very vile comments about the business and the staff members visible, my partner included. In some cases ID and name tag badges were zoomed in on etc. I have attempted to get these taken down off facebook, but with no success. Has anyone had any success in doing so ?

    Is the avenue to follow the ( potential GDPR ) breach ? Or filming without consent? Harassment ? The law seems very vague on what is and is not permitted ( no violence was used, but behaviour was threatening on occasion)

    GDPR and no consent to record will be non starters. There is no offence being committed.

    Harassment - unlikely that it would reach the threshold to constitute a criminal offence. The individuals involved will say that they were simply engaging in a protest.

    There could potentially be a public order offence, but even that is probably a stretch. If there is a recurrence it may be helpful to notify gardai.

    Annoying, but I would be inclined to ignore and move on. These groups usually get fed up and jump on some other bandwagon before long.

    Yes, we did reckon there probably was no hope of removal. It's annoying, as the comments it attracted were vile, and as the names and nametage of staff were visible also, it seemed to be increasing risk. There needs to be a clear demarcation of what is and is not acceptabel to post online from inside a business where staff are just doing their jobs. ( Ironically she tells me if the pharmacy themselves were doing a promotion, everyone who was photographed would need to give signed consent) Nutsville.

    You might have more luck with the "vile comments". comments can be reported too, esp if eneough people report it.

    If the vile comments are threatening in nature then perhaps alert the Gardai.
