Solicitor refusing to communicate

    Hello


    I purchased property back a few years ago, it took a while for the sale to go through approx 2 years due to title issues.


    that property I purchased was part of a property that was sold in 2 lots.


    I was informed by my solicitor that the sale had gone through approx in 2021.


    I just happened to check landdirect this year and to my surprise found I was not named as the registered owner on the folio of the property I purchased.

    I have an email from the PRAI advising no documents have been received at all.


    I have been trying to contact my solicitor for the past few months this year and keep getting fobbed off by the receptionist and who advises me that my solicitor is not taking appointments at the moment.


    I am just wondering what road should I take here - should I get another solicitor to send my current solicitor a letter to get him to engage or should I contact the law society for help (might be a bit to heavy handed ?)

    Not heavy-handed at all. I would write, not call, saying that you are concerned that your property transaction doesn't appear to have been registered, that you have repeatedly been unsuccessful in trying to communicate with him to find out why, and that if you don't hear from him by return you will make a complaint to the Law Society. Keep it short, keep it civil, and keep a copy of the letter. Wait another week or so and, if you've still heard nothing, contact the Law Society.

    If your solicitor doesn't contact you before you get on to the Law Society, they very likely will shortly afterwards.

    How did you come to instruct a solicitor like this in the first place? Who recommended her?

    File a Subject Access Request (GDPR) and ask for a full copy of your file including any payments made on your behalf and receipts (should include the registration with the PRAI).

    I think once you've gotten the documents and seen if the work was actually done back then and maybe its a mistake by the PRAI or something. At that point you can decide if you want to file a complaint against her if she didn't actually register it

    Have a look at the Landdirect.ie pramap online and see if there are applications pending on the folio. If the folio is being split it can take a while to be updated.
