Car crash

    My friend was recently in a crash and it was not his fault but the car he was driving was old and felt sorry for the occupants of the other car and let it go but he had to get three things done to the car and asked would they pay after it was done .nothing much just 300 but they can’t afford it so what details does he need to give them or what do they need to do themselves they said they want to go through the insurance thanks

    Other party are being asshole as there insurance Excess will probably be 500 anyway so it going to cost them

    Well he gave them a lifeline he’s a quiet guy really and kind I told him he should have went through insurance but he said the car is only worth 500 .

    Does he have to give the guy who crashed into him any details or just get his insurance details

    Well that's what insurance for and why you should follow the correct process.

    Doing it any other way requires full cooperation of the other party which rarely happens.

    If the car is only worth €500 on paper and the damage is in the region of €300 the insurance company may decide to do a write-off. I was in a similar position a few years ago. My car wasn't worth much on paper but was worth a lot more to me - to replace it would have cost a good few thousand.

    Thankfully, the parents of teenager who drove into the side of my car, were happy to pay for the damage done, rather than me take it further. Win-win situation.

    The guy who crashed into him is messing about asking for his insurance details so he rang a friend of his and he wasn’t sure what to do really that’s why I posted he’s too kind hearted I would have rang the insurance company

    Not your usual post accident situation so here is my unusual piece of advice.

    Just let it go.

    The car is already fixed and paid for, it's not worth the hassle for e300.

    It's up to your friend but I still wouldn't bother for the sake of e300.

    Just by the way, he may be undervaluing his car.

    Good clean secondhand cars have gone up in value since Brexit.

    Could be a 3rd party personal injury claim coming down the line from the other driver.Exchange of insurance is obligatory as far as I know.As for car value-with a value of e1.000(best estimate) or less,for a claim of e300 the insurance will probably declare a write off.Personal injury claim is something else

    If the other party is looking for your friends insurance details, they need to wise up and realise the risks here, they already have convinced him to not go down the insurance route, next they say they can’t pay out, next they’re looking for his insurance details.

    Your friend needs to wake up, and at least notify the other party’s insurance company of the incident. Your friend comes across as a bit of a soft touch, and could easily be taken advantage of here.

    Your friend is definitely walking into massive trouble, its classic a personal injury claim is on the way, and you have no record, no witnesses or anything. Meanwhile they are getting doctors reports etc getting everything in line and also a claim for damage to their car. You wont fix a scratch for €500, nowadays, regardless of age of the car! THE ONLY REASON THEY COULD POSSIBLE WANT YOUR INSURANCE DETAILS IS TO MAKE A CLAIM AGAINST YOU!

    If he doesn't have the insurance details hopefully he has the reg. He can contact Gardai to get their insurance details from that. Gardai will only make sure both cars are road legal, nothing else.

    Correct thing to do is take pictures , take other cars details and notify your insurance of accident

    Let insurance decide liability

    You can be in trouble if you don't notify your own insurance

    Should the local Garda station be called just to get them to log the fact that there was an incident? I realise it would be a wast of resources for them to respond to what is probably a civil matter and there would be no need for them to attend the scene.

    They only response to a crash if someone was injured.

    I called them to report someone reversing into me just to have on file in case it got messy but they said it wasn't necessary as I had the drivers details. If I didn't get details they would call both parties in for a statement and make sure everyone is road legal and go from there.
