Tax confusion

    My husband works remotely from Ireland occasionally for a UK umbrella firm. He is taxed in UK. He has only moved to Ireland since the middle of pandemic so has no tax registration but does have a PPS no.

    His company will not set up the system to pay PRSI etc in Ireland. Can he set up as a sole trader to legitimize and pay Irish tax on his erratic income?

    There's not much setting up of a sole trade. What he needs to do is talk to an accountant to discuss registering for tax (file Form 11), consider his residency/domicile, paying voluntary Prsi contributions, available tax credits.

    Income from an employment is primarily taxed in the jurisdiction in which the employment is carried out.

    The jurisdiction in which the employment is carried out is where the employee is physically present(Ireland) when carrying out his/her employment duties for which the employment income relates.

    There are some exemptions mainly for short-term work-related trips, these do not seem to apply to this scenario.

    There were also some COVID-19 related exemptions, but those have been mainly phased out.

    Your employer is obligated to register for payroll taxes in Ireland and to operate this system, deducting these payroll taxes from your salary and remitting same to the Irish Tax authority on your behalf, in addition to employer PRSI.

    There would be no point in you setting up as a sole/trader as the substance of the arrangement is fundamentally the same, i.e. an employee/employer relationship still exists.
