Planning permission for back of house

Was thinking of two story extension, everything way too expensive so looking for plan b.

The house is at 45 degrees and we are thinking of doing single story going straight out the back. Obviously if you go out the side of your house you need planning permission but what if you go out the back at an angle , rather than co-linear with the side. It's just as difficult to see anything from the road and you are still 10M from the front of the house. Does this need planning permission?

ie you cannot go a little to the rear, and then off to the side, and claim its still all to the rear.

I encountered this situation years ago where a proposed extension was going to project close on 2.0m past the side wall of the house. I rang the local planning office and they said that as it was wholly behind the rear "building line" it was exempt subject of course to complying with the usual conditions. In hindsight I should have got a formal section 5 declaration on it.

and typically the advice ive been given previously in different situations is, once it becomes visible from the front ie beyond the side walls, it requires permission.

That goes against the advice and determination of some DCC Planners and Planning Enforcement Staff from my experience.

I would have considered the below to be exempt. Maybe I’m misunderstanding what the OP wants to do?

Oh we both know how various regulations can be interpreted differently not only from county to county but even between planners in the same dept.

and i have been advised on a few occasions that that would require planning permission, and i have applied for planning permission for many such extensions.

to bring it to its extreme, theres no way the below can be considered exempt from planning permission.

i would certainly echo the "if in doubt apply for a section 5 declaration" advice

That's a good point and in the example shown I would consider that to be a side extension. My own personal view would be so long as the biggest portion of the extension is located behind the rear building line then it would be seen as a rear extension. But that's just me.

I would love to see an ABP determination on this.

The view can be taken that the “rear of the house” is confined to the area beyond the

rear wall of the main house, excluding any additions by way of extensions, or

structures ancillary to the residential use of the house that project beyond the

side/gable wall. As such, the extension would not fall within the definition of Class

One in that an extension must extend from and beyond the rear of the house if it is to

be in accordance with the description within Class One. On the basis of the

foregoing, it can be concluded that there is no provision for exemptions for

development to the side, even if the projection is at the rear of the house such as in the

case of the development subject of the Question and therefore that the development is

development and is not exempted development.

Taking into account, (with reference to section 4 (1) (h) of the Act), the contemporary

design, which is in contrast with that of the house and that of the neighbouring

structures, although not in views from the front, and the larger projection to the side

involved, compared to that subject of the Question in relation to the development at

Gledswood Drive (RL 2331 refers), I would tend to take the view the subject

development does not constitute exempt development.

i havent gone looking for ABP determinations to the opposite, but i wouldnt be surprised if they exist.

I think what the OP is asking is because the house is at 45 degrees to i assume the boundary lines, does he need to extend parallel with the boundary or with the house

It reads to me like the house is at 45 degrees to the road, so they are asking if they go out the back parallel with the side walls, would they still be exempt even though the extension would be visible from the road, and the answer is yes they would still be exempt

Yes it like this. We want to go out at 90 degrees from the very back of the house about 3M. The house is at a 45 degree angle so it's really hard to see that 3M.

It's more like the second one. Except we're at the end of a cul de sac and the roadway runs perpendicular to how you have it. And we have a big hedge so I can't see how anyone can really see it?

It's an old free version of "Sketchup" from when Google had it for free, I don't know who owns it now but it aint free now.

There lots of free drawing stuff like "floorplanner" or even Paint would do.

I'll change the road, and see how it looks.

The rear of the house is clear.

The side is also clear.

What’s unclear is the area that is both to the rear and the side. It’s pretty much up to interpretation.

In a very strict sense, it says “to the rear” and not “not to the side”. So to the rear and side should be ok. But section 5 sounds good
