Contract clause

    Hi all,

    my employer is potentially closing and there’s a clause in my contract regarding this that I’d like some help clarifying.

    “Notwithstanding any other terms or conditions expressed or implied in this Agreement, in the event the Employee will discontinue operating its business at the location where the Employee is employed, then, at the Employer’s sole option, and as permitted by law, the Agreement will terminate as of the last day of the month in which the employer ceases operations at such location with the same force and effect as if such last day of the month were originally set as the Termination Date of this Agreement.”


    is this essentially saying that they’ll only give us notice to the end of the month? What happens to the rest of our notice period that’s in our contract?

    to me its not saying anything about notice given and just saying that your contract ends on the last day of the month that they cease trading - I assume that covers if an employer is given a specific time contract - for example if someone is halfway through a 1 year contract and the business closes then that contract ends in that month.
