Does social welfare go ahead with legal proceedings?

    Hi all,

    My friend's ex partner got a letter this morning advising that the case MAY go legal if he doesn't up his maintenance.

    He pays 30e a week for two kids and hasn't responded to the letters. This was headed as a FINAL notice.

    Surely it would cost social welfare too much to bring every Tom, Dick and Harry to court?

    She's secretly hoping they do to get more maintenance.

    Also shes on One Parent Family at the moment which is why they are chasing him.

    Yes, they will if he fails to engage at all, over a prolonged period. Many factors - his ability to pay, is he on some or full form of social welfare himself, or is he at work - age, are there other new dependants etc etc, are they Legally separated, divorced , or never married in first place - etc

    An idiot ( male) friend of mine was brought to court , he had enough to pay support no hassle, but was in a new relationship and was not sepaking to his first partmer at all . They were never married, but it was teh failure to engagen with anyone that caused the problems.

    Thanks for your reply. He's working cash in hand, not on social welfare that we know of, but he does own two properties. He was bragging today that they are empty treats from social welfare but the final notice letter seems serious enough!!

    Thanks for your reply. No, she's claiming One Parent Family, he's only giving her 30e, so social welfare have asked him to give more & he hasn't replied to them. Now they are threatening legal action - wanted to see if they actually do proceed with this, or if its just a threat.

    I sincerely hope that you or she or someone has told SW that he is working illegally and he owns property. There’s no reason for his kids to be living in poverty while the taxpayer tries to mind them as he can afford to support his own children. €30 wouldn’t keep a goldfish.
