Keeping a refund and the item refunded?

    Hi all,

    I recently purchased a new laptop online. I received an email from the seller shortly after telling me the item was dispatched, and a courier to track the item. After a week or so, there was no update on the courier's shipping, so I contacted the courier to find out what happened. The courier told me they had not received the item from the seller. Upon contacting the seller again, they too had no information on where the item was. The seller then offered me a refund for the laptop which I received back to my card. That was almost a week and a half ago. Yesterday, the laptop I had originally ordered turned up at my door. So now, I have my refund from the seller, and the original laptop as ordered. Am I legally entitled to keep both? This was all a mess up on the part of the seller.

    Are you legally entitled to keep both? No, you're not. Either pay them again or ask them to pick up the laptop at their expense.

    Well, I have every intention of keeping both. This was their error, not mine, and I will not be giving in.

    You're not entitled to keep both, and there is absolutely no justification to do so either. This isn't some cheap item that required a vast amount of effort to get a refund for.

    Inform the retailer the item has arrived and to arrange a pickup. They are likely to become aware that has been delivered anyway, so its not a case that keeping quiet will do anything.

    Then why the f@ck did you ask the question in the first place? You obviously have no intention of listening to any advice on the matter so why are you wasting people's time?

    Shouldn't really get to the legal question, morally you should pay for it or return it.

    The seller should receive confirmation from the courier that the item was delivered.

    They may contact you to get the item back, and it should be at their expense. Maybe they'll come after you if you don't, or maybe they'll write it off. Who knows.

    My question was about the actual legality. I couldn't care less about morally keeping the refund and the item. I would like to know where it is stated legally that I am in the wrong.

    you are in the wrong on all levels. you have no legal basis for keeping both the refund and laptop.

    You haven't paid for the item, hence its not yours to retain.

    Anyway, I think this is a very poor trolling attempt so I'm closing the thread. Do not attempt to recreate it.
