How could a racially-motivated killing not be proved as being murder?

    How can the killing of a black person by white persons (at least one of whom had a knife and stabbed the victim to death) who were shouting racist abuse at the victim as they chased him not be regarded by a jury as being murder beyond reasonable doubt?

    The evidence (including CCTV footage) indicated intention to cause at least serious harm, which in itself is enough to prove a charge of murder.
