College Fees for Irish student returned from abroad

My daughter returned from the USA in September 2019. She started a 4 year degree in September 2020 and did not qualify for free fees and has had to pay over €7000 for her first and second year. She has been living in Ireland now for 3 of the last 5 years. Should she be eligible for the free fees for year 3 and 4?
