Ticwatch/mobvoi wont replace or repair watch less than 5 months old.

I have a Ticwatch pro 3 for a little over 7 months now which i had purchased directly from the mobvoi site.

After about 2 months the FTSN display stopped working so i contacted Mobvoi and they asked did it have any knocks and was it in water so i told them the truth i wear it in the shower and no knocks or anything like that. They replaced the watch without any problems.

Now 5 months later the FTSN display was showing the battery as nearly dead when i had just charged it. The coiour display showed it 87% which was about correct. I reboot the watch but it wouldnt turn back on nor would it charge or show any sign of life. Like last time i contacted Mobvoi and told them the truth but this time they are saying they wont replace it as the waterproofness wears off over time since i use it in the shower. They have not even inspected the watch so for all i know the issue has nothing to do with water getting into the watch.

Seems odd they replaced the last time but wont this time.

What am i to do here? The watch is suppose to be swimproof for 30 mins and i never even went swimming with it.

Believe it or not there is a difference between submerging and showering. They do specifically state in their faq that it's not to be worn showering. I doubt you have much of a case, as they do specify not to wear in the shower.

if thats the case they should not be able to market the thing at all as water resistant. There FAQ reads iike they have 0 water resistance. I had a garmin for 3 plus years and use to wear it swimming and that had the same resistance rating and i never had an issue with that. This thing is not fit for purpose at all.

It's rated at IP68 which says swimming pool, if a sports watch is only rated at IP68 for 3 months then I'd be going for not fit for purpose . Did you buy from the Irish site?

Yes i bought directly from their site.

Its not even the rating if you read the FAQs it states not suitable for showering, not suitable for sea/ocean, chemicals will degrade water resistance, waterflow will degrade water resistance. that means you cant swim in the sea, swimming pool as they have chemicals or a river as they will have a current. That leaves only a fresh water swimming but how many of those do you see if any.

IP68 rating means that you should be able to do them things. Hiding that something rated at IP68 can't be used for swimming is misleading advertising. If you have already tried a credit card charge back, a sports watch IP68 rated that can't be used for swimming or showering!!, the small claims court would be my next port of call.

Limit is 120 days from purchase.

There is a different policy for future dated items where you have 120 days from expected delivery date, but an overall 540 days. So if you bought something that was for delivery in 12 months time (concert ticket for example or holiday), you would have 120 days from when the concert was due. But a max of 540 days.

They do specifically state in their faq that it's not to be worn showering.

if item is misused by enduser they don't have to replace. It appears OP has admitted using the device in a way specifically advised against. OPs assumptions don't have any legal weight.

You might assume its good to use on mars because its a similar terrestrial planet - astrologically speaking. But if the FAQ clearly explain it is not then manufacturer is covered.

If you read the FAQ it also states cant be worn in Sea, water with chemicals, flowing water etc... so in that case it means it cant be worn anywhere other than freshwater pools and how many of those do you come across.

In my opionion its not fit for purpose as if i had said i wore it in a swiming pool or sea or whatever then they would say its not meant to be worn there either. They replaced it before when i told them i had worn it showering and never mentioned then that i was not meant to wear it in the shower. Nor do we know if thats even the root cause of the issue. They have not even inspected the watch. It could be a totally unrelated issue with the watch other than water damage.

It's rated at IP68. They can't sell something with an IP68 rating and say don't use showering when it's supposed to be rated for swimming. They can hide behind their T&Cs for warranty work, luckily in Ireland we have stronger protection and a sports watch that can't get wet isn't fit for purpose.

Have a read of this, IP68 means water resistant, not water proof. You could drop it in a meter of water and it should be okay.

It does not mean it can withstand water pressure or being in water deeper than 1 metre though.

A shower would have a lot more water pressure than 1 metre.

Yeah guys just reading a bit more about these IP68 ratings.

I'm into watches but the more traditional kind so measured in ATM when it comes to water and swimming. There are different things you can do in water depending on the ATM/BAR rating on a watch.

It's not so much to do with just dept but the actual pressure. Different activities result in different water pressure.

IP68 being measured in a static 1 metre underwater to get a rating is going to experience far less water pressure than your arm being quickly submerged into water again and again while swimming.

I would definitely not be swimming with one of these things.

If you want a watch you can swim with, get one with a proper high ATM rating.

You most certainly can sell an IP68 that's not to be worn swimming or showering. IP68 is water resistant to a certain degree but not water proof nor suitable for swimming or showering. That's the whole point of the rating.

Had a look at their ad, the bit about swimming is a bit dodgy and does sound a bit dishonest when reading up on IP68 ratings. Definitely wouldn't call it 'swim suitable'
