    Myself and my wife were driving down a small country road just enough room for one car .

    Another car was coming towards us so I pulled over as far as possible and stopped but the other car just kept coming at us and didn't even slow until I flashed my lights and beeped the horn but it looked like she had her head down and when she looked up it was too late and slammed into the front of our car. The fire man said on these roads its 50 / 50 . Anyone have any experience in this situation.

    Unless you have camera work it will be an uphill challenge to prove anything , try appeal to the other drivers nature and close an agreement quick if you can.

    I'm guessing you didn't call the guards or you wouldn't be asking the question.

    It's not 50/50 when you were stopped and she drove into you, that's 100% their fault.

    Will she admit liability?

    The guards were called but he said he wouldn't be able to give his opinion on it. The fire man said its normally 50 50 on these roads even when I showed him the only skid marks we're from her car . It just seems very unfair and our brand new car is in bits.

    Did you get photos of the position of the cars? Marks on the road etc?

    There was a similar thread here a good while back and the poster, who was stopped like yourself, was able to get data from his dealer/manufacturer that he was stopped at the time of the accident. If your car is not too old it might store this information on the on board computer.

    Yep, he was able to pull the speed the car was moving at the time the bags deployed. If you could match that to pictures it would be perfect. You need evidence to back up what you say.


    I wouldn't worry about opinions of anyone present, evidence will be the key.

    No mention of airbags going off here though. Not sure if the data would be kept otherwise?

    Funny enough the airbags never went off even though the front of the car is destroyed.

    I'd still ask for to be checked. The car could have recorded the impact and activated seat belt pretensioners etc.


    What car is it? Obviously the newer and more modern it is the more sensors will be present. Did you take pictures?

    I'd get the dealership on to it, pull the data and get them to report on what it means. It's been done before. All it will prove however is the car was stopped, it won't provide detail on its position.

    2018 onwards cars should have sos button - eu system. Did you get an unexpected call from the control centre?

    the sos systems sends gps location and speed at time of accident to the eu wide control centre. This works without you needing to have a mobile phone.

    even if you did not get a call (maybe airbags need to go off) the information may be available.


    and by the way this mandatory system will make it very easy to implement auto speeding fines and road pricing, as well as tracking

    it wont be long before Individual countries request this live info from the eu, may require voting to allow in countries though

    if you don’t know about sos and have it in your car then press the button - just say it was a mistake! I did a few years ago

    The sos data is separate from manufacturers data I believe so you may have two places to get it from.

    That is terrible. Hope you get sorted and she pays for your damage. Nothing worse. I remember many years back now being in an accident where we were parked before the one line waiting to go onto the main road and some ass came along in his big car cutting the corner hitting us and then trued to blame us fir the damage to done th his car the asswipe. It ended up being 50 50 in the end even do we had pictures disgracefull. Another accident that my sister was involved in the Garda said he was on her side and gave a statement to what happened but later changed it so I agree do not trust the Garda. They can be asswipes too.
