Penalty points query

    I didn't want to derail another thread, so I'll ask here.

    If you accumulated 12 points, then get a 6 month ban, after the 6 months, is the slate wiped clean?

    ie. if you get 12points in 1 month, do 6 months off the road, are you point free after 7 months?


    Btw, I'm at zero points, always have been.

    After you accumulate 12 Penalty Points (full licence holder) you will receive a letter from the RSA advising that your licence is to be sent to that Office and informing you of a period of suspension beginning 28 days from the date of the letter. One thing to be aware of is is your licence lapses during that period, the period of suspension will extend until you renew your licence and the full sic months is served. This also applies to the application of Penalty Points on a licence in the normal course. For example if points on my licence are due to lapse on 30/06/2022, but my licence lapses on 30/05/2022 and i fail to renew the licence until 15 July, the application of the Penalty Points will lapse from 31/05/22 until 15/07/22. When I renew my licence, the remaining time period will have to play out.

    Correct, at the end of the disqualification all points standing at the time of disqualification are removed even if they exceed 12.

    That's gas, so I could drive like mad, rack up 12 points, pay the fines, feic off to Australia, Canada or south east asia for 6 months, come back, and all is good.

    You could just rack up the points, and not go travelling. Just don't drive for 6 months.

    What if a person is caught for a 5th time before receiving the final set of points, thus giving the person 15 penalty points?

    After the 6 months on the bold step are all 15 points rescinded or only 12, leaving the driver with 3 points after the ban?

    What if the driver is caught 8 times in short succession? Will they have 24 points after payment of the FCPNs?

    I know of 2 that got 12 points, got the ban and never handed in the licence, 1 lad did 3 months before he got the shìts of it and went back driving, the second drove for the full 6 months, obviously neither were pulled during that time but I always wonder why the guards are never required to make sure drivers hand in the licence, neither informed their insurers but I've no doubt if anything happens in the future they'll pull out that card if they look into it

    Nothing unfair about it. If you are driving on the road you must have a valid licence.

    Allegedly 1 in 13 drivers is driving uninsured here. I'd say that your two buddies fall into that group if the above is their approach. If I'm wrong and they have an insurance policy, their insurers will more than likely look for the number of points* in which case they've lied and aren't properly covered (if covered at all).

    * some insurance companies look for the licence number and check the number of points themselves. In this case they would find that your buddies dod not disclose the 12 points and subsequent ban and so their insurance cost would be through the roof.

    I would dispute that figure of 1 in 13 being uninsured.

    I have a few cars/bikes that only come out for a few months a year, if they come out at all.

    When they do come out they are insured, but the rest of the time, they are garaged and uninsured.

    I'm sure that they are included in the 1/13.

    I would be curious what % of cars on the road are uninsured, I doubt it's as high as they claim.

    Theyd be a lot insured but their policies are worthless because of non declarations etc

    So i hear anecdotally

    This mantra of "utmost good faith" in insurance is very convenient for the insurance companies when they can simply take people's money without any due diligence

    A lot of people will do anything to stay on the road

    There is no way to know for sure if it is 13% (or 10% or whatever) and the likes of your cars will probably be included in that 13%. However, AGS are apparently pulling a lot of uninsured drivers daily using ANPR...
