    Your brother's request seems to be contradictory - he seems to want there to be record of him supplying water to you and he also thinks this may devalue his property - couldn't he simply issue you a receipt? I presume the money involved is not huge.

    On the other hand, why don't you simply oblige by lodging the money into his account as he wants?

    I'm not a legal expert but I would think that paying him only shows that you are not entitled to a FREE water supply.

    I suggest that you talk to your solicitor about the wayleave.

    I can't imagine that a wayleave for a water supply would have a noticeable effect on the value of your brother's farm. Maybe you could negotiate something with him, though I get the impression that your relationship is not great.
