Neighbours Terraced bungalow extension planning exempt?

    A neighbour is currently extending their end of terrace cottage/bungalow. Its a small 25sqm cottage with attic converted into an upstairs bedroom with velux windows. The house is at a 90 degree angle to my back garden and gable wall is approx 1.5m from boundary wall.

    After reading the planning regs, I am confident he cannot develop within 2m of the boundary wall (class 1 section 3.0) and cannot have a window within 11m upstairs of the boundary (class 1 section 6.0 (b)).

    My question: Are single story properties with existing attic conversion allowed to add 12SQM 1st floor extension as part of the development without planning permission?

    There isnt a yes or no answer Im afraid. If it was previously converted then it would be no however if it was approved planning for attic with the original PP then the answer would be yes.

    Thanks Muffler, this cottage is approximately 100 years old and nothin more recent after running through records available on the planning site.

    Ideally would like to speak to the builder who is also the owner (rental property) but theres been difficulty there in the past.

    C.1(3) only applies at first floor. At Ground floor he can build right on the boundary.

    C.1(6) only applies to windows facing a boundary. A window perpendicular could be 2m from a boundary.

    Nothing in the OP conflicts with those, but maybe there are more details left out.

    Thanks Mellor.

    Its not built yet, he's in the process of laying foundations and has stripped the existing roof of tiles etc. which would suggest he is planning to go up.

    For C.1(3) his house is currently 1.5m from my boundary so if he goes above ground floor he is contravening this?

    My concern is that if he goes above ground floor with a low pitched roof sloped away from our house he will install a few velux windows facing our garden at the pitch of the roof so not perpendicular like a ceiling window. These would constitute windows facing a boundary per C.1(6).

    Again would like to speak to him but previous issues would preclude this unfortunately.

    Is there enough back garden/yard space left to comply with regs if he extends, leaving aside the windows and boundary issue for the moment?

    No issue with back garden space in fairness, looks like approx 40sqm after development.

    He would only breech C.1(3) if the new wall aligned to the gable. If he offsets it by 0.5m he can build to two stories.

    The venue is a grey area. Not specifically permitted other than general window limits. But obviously a window facing up at 20 deg, is less intruding that a normal work due at 90. Some councils take the view that view that veluxes tub the rear are ok, but not sure where you are.
