If it's a boundary wall then by the definition of boundary one side of the wall is on their land, or is it built entirely on your land?

In either case how do you maintain it without trespassing?

The wall is entirely on our private property and maintenance was done (painting) was done with their permission, theirs is council property they don't own the house or grounds and the wall was built and paid by us alone

If the wall is inside boundary, you should have established this as fact and marked / fenced off the actual boundary before building a wall near boundary and allowing neighbour direct access to their side of the wall. In such situation, it is reasonable for new tenant to assume wall is boundary marker.

Just stepping back a bit here........surely the council ( NOT the tennant) determines what colour / maintenance is done on 'their' side of the wall. Regardless of who originally erected/ paid for the wall that 'side' of the wall is not under your remit/control......as another poster eloquently put it " one side of the BOUNDARY is technically ( legally) theirs.......hence the use of the term " BOUNDARY" wall
