Non Compliance of Extension

    Hi Looking for some advice as am unsure of how to proceed. I am sale agreed on a small cottage which includes an extension to the back.

    I received a certificate of compliance from the vendor solicitors and it states that:

    The single story extension (16m2) was built pre 92 so is exempt from planning and building regs.

    In 2012 a dormer extension (9m2) was added over the single story is also an exempted development BUT it is not in compliance with the Building Regulation (does not state why on the cert but on the contract sale its states that it is due to ventilation and ceiling height).

    Our surveyor did not advise on this just advised to get our solicitor to obtain all relevant certs relating to same.

    My question is now what issues this may cause me i.e insurance etc and if it will hinder any future planning as I was thinking of knocking it down anyway and rebuilding new extension but not straight away. or should I just walk away and save myself the headache ?

    Some issues I see here


    1. built pre 92 means exempt from building regs but may have building bye law approval.
    2. planning exemption has nothing to do with 1992. There is a pre 1963 stipulation in the planning regs.
    3. dormer added in 2012, how is this exempt??

    Think its just badly worded, pre 92 was regs and 16m2 was planning exempt development. Again, the 2012 dormer at 9m2 over 16m2 is under the threshold for exempt development as long as the other criteria are met.

    If you're planning on pulling down the extension, it shouldn't make a difference for planning. For insurance purposes, the dormer room is not a habitable room but should be fine if considered a storage area afaik but ask the insurer.

    Sorry yes worded that wrong earlier. That's exactly what I meant alias and thanks for the response, I feel a bit more at ease now, cheers. I'll get on to insurance companies tomorrow and go from there thanks again.

    A dormer extension can never be exempt.

    it’s an alteration to the roof profile, which no w=exemptions exist for.

    Any pitched roof extension to the rear of a property would be a change to the roof profile but can be exempt subject to size and staisfying the other criteria. Again I'm wondering if its badly worded and is an attic room with a velux but being described as a dormer.

    Maybe I’m. Issuing something obvious here but I have never seen a dormer roof/window added that was exempt.

    can you give an example?

    A dormer in the original roof would not be exempt but there’s no restriction on a dormer being incorporated into an extension provided all the criteria are complied with

    As Doug said above. There's no restriction on a dormer in an exempt extension.

    It sounds like they just wacked on an unexempt dormer, but its not clear as there talk on extensions also.
