Balanced Flue - Proximity to adjacent buildings

    Hi all,

    I'm currently building a single story extension to my terraced house, which includes a gas stove with a vertical balanced flue.The balanced flue extends 600mm above the roof.

    My neighbour now states that they're not happy with the location of the flue as they consider that it will blow fumes into their bedroom window. The flue is approx 2.1m from their bedroom window.

    Part J of the building regs states in one section that if a gas flue terminal is below a window or roof light, that the minimum distance is 2m.

    In another part of the document, it states "the outlet from an open-flued, natural straight appliance, for residential heating, (or comparable applications), located on a roof adjacent or adjoining a higher building should terminate above the prohibited zone as shown in Diagram 2 irrespective of the fuel type".

    From my reading, the measurements in Diagram 2 could be applicable to me. The million dollar question which I think this revolves around is: Is a balanced flue considered an open-flue?

    Does anybody have any prior experience or insights on this, or locations where I can get a definitive answer?
