Cannabis Possession Ireland

I recently got caught with about 3g worth of cannabis in my car when searched by undercover Garda. One of the Garda said I will receive a call but the other one was asking if I had a solicitor. I had a court summons 7 years ago for the same charge when I was caught at a music festival but I paid to the poor box. My question is: how long should I be waiting for a call about a caution or should I be expecting a summons in the door? They took my details and got me to sign their notebook confessing it was cannabis.

Is that 3 grammes worth or 3 grand worth? It might make a bit of a difference.

While yours is a valid question /observation, personally, I strongly believe if it were 3 grands worth the OP wouldn't be looking for advise on boards.ie, I've been wrong before though so.......

If it were 3 grammes worth I wouldn't be to worried about it, more so I'd question why they pulled you over in the first place but that's none of my business 🀷ðŸ»*♂️

They can (and often do) take up to 6 months to send a summons. I would just assume you will get one and not a caution, especially since you were driving and especially since you had a previous. Sucks but as with everything else we are way behind the times with cannabis possession laws.

Try not to worry too much about it, the worrying will be worse than whatever slap on the wrist they give you in the end up.
At the same time don't get your hopes up that it will just be a caution or go believing what the 'good cop' said. Once got searched and had nothing found on me, was driven home, told I wouldn't be charged, and 5 months and 3 weeks later got a summons for obstruction, claiming I had struggled with the plainclothes guard who had jumped out of an unmarked car and tackled me.

You cannot get legal advice on here so get onto a solicitor or FLAC.

Hypothetically speaking, in what circumstances did an undercover Garda stop a motor vehicle and then proceed to search it was there any reasonable suspicion a commence was being committed. Was it a standard checkpoint or anything more as hoc?

3 grams worth. Worried about losing my license also. I hadn't smoked in 3 days prior and was not tested.

I was in a dodgy area paying for the bag that they seized off me. Very foolish of me. I have since given up using with help from others

My main worry is that I am a university student and I have been receiving first class honours grades. I may aswell drop out now and live off the state? I have been able to stop all use with the help of others. Your story sucks man sorry to hear that happened to you and hope it worked out in your favour in the end

Minor slap on the wrist eventually but takes time. (If at all considering the minor amount)

If all you got before was poor box then I think you can still get a caution. Minor possession was recently added I believe.

Thanks for the reply. I have stopped all use and plan on staying off it for good. It's not worth all this hassle and misery.

Well that's a personal choice on your part. Was never my thing too be honest but I have known plenty of smokers. One know 1 that had to knock it on the head because of the mental effects. Others still probable smoke without issue but I'm not in touch anymore so maybe not.

It's getting to the legal stage but the wheels turn slowly. Probably not completely legal in my life time.

I actually worked with a us citizen a few years ago in Spain that was fond of it but he had a record from back home. Really was ****ty to see the issues it caused him. Got denied entry and work visas in a lot of countries which was a real shame as travel was his life

It seemed to have helped me through a very depressive part of my life but to be labelled as a criminal for using it has opened my eyes. I am two weeks clean and will try to keep going. I am a law abiding citizen and the thought of being labelled a criminal just turns my stomach, along with the restricted abilities you mentioned. Thanks again for your feedback. Much appreciated
