    Hi there

We recently went sale agreed on a farm. There was a lot of back and forth with the vendor who finally decided that he wanted to take his entitlements with him when he moves out in October? (He is obviously staying on for his payment in mid October)

Does this mean we can go to the national reserve for our own entitlements? Is it much trouble? It's over 50 acres so it isn't a small holding! I have said that I need it in writing that he will be leaving the land naked for us. (I said it like I knew what I was talking about too!)

    Thanks in advance!

Aren’t there eligibility criteria to get from the national reserve, do you meet these ?

Know someone turned down because their off farm income exceeds €40k

Both myself and husband are young, trained farmers, awaiting the sale to go through for our herd/flock number for a partnership. We I have my green cert from a few years ago and he will be starting his before the sale goes through. I think that ticks all the boxes?

That ticks the new entrant/ young trained farmer boxes.
There's still the 40k limit in off farm income which you need to meet. Check if it's 40k between both of you or if you both only need to be below 40k.

Is that 40k threshold taken from previous years or current year?

Either of last 2 years whichever benefits you I think.

Is it 40k in take home pay or Gross pay? Like, could you increase pension contributions to bring it below the 40k in the preceding year?

Gross, the below link might help.

OP when the vendor put the farm up for sale did he put entitlements up for sale with it. Did he discount you much for taking the entitlement.

For the moment you should only put the herd NUM er in one of you names and apply to the NR in one name for the entitlements. This way only one income will be taken into account. If you decided to rent a parcel of ground later the other person can apply and start farming in there own name

Is it 40k between us, or each? Sorry for all to questions, this realm of farming is like black magic!!

Regarding convergence and bringing all up to 60% of national average, having started on very low value entitlements, what should my Unit value be now, minus greening?

Joint herd number – the gross off-farm income of all members of the group are taken into
    consideration (€40,000 limit applies to the group);

I think that if they determine that the existing entitlements were sold with the intention of creating naked ground then that make you ineligible. I don't know if that is the case for sales. Either way, I'd tread carefully before doing anything with what you get in writing regarding them.

I think that you could apply to national reserve anyway to get existing ones topped up anyway.
