Fresh application for Disability Allowance

    I know somebody on Disability Allowance who is due to inherit a plot of land and money and who hopes to build or buy a primary residence. The Department told him that a primary residence is not assessable for Disability Allowance.

    The Department said that if he purchases a home to live in he should submit a fresh application for Disability Allowance. All qualifying conditions (means, medical and habitual residence) would be reassessed on receipt of a fresh application.

    Is anyone familiar with how a situation like this works in practice? Is the fresh application submitted before the home is bought or afterward?

    Whatever about a POSSIBLE inheritance or Purchasing a home, any application that is means tested is on CURRENT means, assets etc not what's a possibility. The Habitual Residence your referring too is not I believe anything to do with a property or its ownership, its to to do with being resident in the state (Ireland) unless your meaning something else.

    More to the point regarding Disibility Allowance, again, I'm a little confused. This benifit is primarily awarded on Health grounds, lack of ability to work etc, it's not something you wait to apply for in relation to changes in personal or financial circumstances. Whilst means testing does form part of application, the primary concern for the deciding officer is the applicants lack of ability to work for a defined period of time, generally up to two years and the application requires quite detailed medical reports, diagnostic info etc.

    Do you mean that the inheritance will put them over the threshold so they don’t qualify for any DA due to excessive means and after the house is built they will then qualify again as they then have a house and no money, so would reapply at that stage?

    That seems to be what the Department is saying although it isn't completely clear if the fresh application is submitted before the home is bought or afterward.

    It would be after the money leaves your bank account.
