Alert on Folio

    Hi,

    i have a property alert on a folio on the land registry online.

    Within the last week I was alerted of activity on thios folio as follows that was submitted by a solicitor on behalf of an individual:

    Application status: Awaiting Attention
    Application type(s): Copy Folio/File Plan, Transmission (Post 59)

    Any know what exactly the above suggest? Is it sale or transfer of the land or simply just a request for a copy of the folio?

    It states the applicatio number also, is there somewhere I can check on this application?

    A transmission is usually a transmission on death. So someone died and they are taking that person off title and putting it in the name of the person now entitled to be the owner under a Will or Intestacy.

    That's usually the case anyway under those applications but there are a few different forms relating to transmissions. Check out PRAI forms 33-47.

    Are you the owner of the folio? On land direct you should be able to see who is the lodging solicitor and contact them. Or contact the land registry directly. Both might not tell you what it's about though unless you are the owner or lodging party. Once the application completes it should go on the folio and you can then take up a copy of the instrument and see the exact papers lodged under that dealing. But you won't need to go that far as once the dealing completes an up to date folio will show whatever changes were made.

    Yes it does say the name of the solicitor and person lodging the application.

    Silly question, but the person lodging it has not deceased however was left the folio/land by a person deceased some 20 years ago now, should the transmission alert state the new owner?

    Can the transmission relate to transfer of title from the applicant to a new person , all of whom are still living ?

    Can a third party, not owner of the folio, see the instrument and papers on land registry?
