No 'Part M toilet' in 2000s house

    I recall visitability issue and for small houses, ground floor toilet under stairs in 1992 TGD Part M. Just came across a house from mid 2000s, two storey, two bed and bathroom upstairs with ground floor area of about 40 sq. m. but no ground floor toilet/toilet under stairs!
    Has any body come across similar in Dublin?
    How can that be possible?

    Part M didnt apply to houses until the 2000 regs.

    the transitional arrangements that applied to this could conceivably allow for a house substantially complete by 31st December 2003 to be under the older 1997 regs, where part M didnt apply

    so youd want to rule out any legal 'non compliance' first

    second, any evidence that it may have complied originally but the wc was removed?

    third... theres been many houses built without due cognisance to the applicable regs, so nothing would surprise me about a mid 2000s house not complying.

    1. No planning permission required for rear extension if area of is less than 12 sq.m in a terrace and less than 40 sq.m in semi-d or detached and if you are retaining at least 25 sq.m private space?
    2. Generally you can build to neighbouring boundaries by agreement with neighbour/s, as areas in 1.?,
    3. If extending at first floor, you must stay 2m. from boundary/ies?
    4. If building works/extension dont need either Planning permission or Fire Safety Cert, you dont need (to serve) a Commencement Notice? You do however need to comply with the 'building standards' parts of the BCA/Building Regs?
    Have I got (most of it) corrrect.

    2. Correct - without windows of course or roof/guttering over-sailing.
    3. Yes. And thats where the 12m2 comes into play. Thats the max. floor area at first floor level in a terrace or semi-d.
    4. Correct.

    Just to add some weight to Muffler's post....

    1. Terrace house can enjoy the 40 Sq. M exemption too. The 12 Sq. M is for first floor extension along with some other limitations.

    2. Generally yes. You can build on the party line and ensure its structurally sound to take the neighbors extension in the future and double storey if required. Ive seen arguments that if you build on the boundary, then that part of the wall is not within your site so not exempt....Ive also seen Planning Enforcement Officers state this is ok and that the wall now becomes a Party Wall which they wont get involved with as its a civil issue.

    3. Yes and remain under 12 Square Meters. But remember then, that 12 must be taken from the overall 40, so it reduces what you can build at ground floor level.

    4. Building Regulations still apply. So the Technical Requirements of the Regs, the TGD's but the Control Regulations dont, Commencement Notice. Fire Cert is not for single family dwellings.

    Thanks Gumbo. Didn't see your post 'til now. Whatever about boundary fences I think people are generally better off staying away from party walls as it could lead to rebuilding, underpinning or at least arguments.
