Solar on planning permission, but not included in build

    Hi, we've just bought a new build which doesn't come with solar on the roof. I don't mind that and wasn't expecting solar but when I looked at the plans submitted and approved for permission I noticed that solar panels were shown on the roof.
    Just wondering if that's a planning breach and if I should push for them to add solar as planned. I want to avoid any issues if we sell in the future and to be honest, if I have a bit of leverage with this, it would be nice to get this done without costing me as the house was expensive enough!

    No, your house comes with permission to add solar in the next 5 years, is all it means! You can apply for planning and not add all the elements in. It's a breach to do things the other way round, add panels without planning.

    Not sure that's the case tbh. As part of part L permissions the solar or some other means of energy efficient running of the household would have to have been included. What that was in this case I'm not sure. Maybe they substituted it. I don't believe you get to ignore or exclude that.

    I made the mistake of not checking properly my BER cert when buying a new built and now I have an A3 rated house with single glazed windows according to the BER cert. They are double glazed and the builder did get the Part L document changed, but if I want the actual BER cert changed, I need a new survey completed for €200...

    Did you get an Air To Water system installed by the builder?

    Different legislation.
    The planning allows for the panels.
    The developer can decide what they want to
    Do with Part L (building reg, not planning reg) as they are building. This includes substitution of strategy from solar to A2W or similar.

    Makes no difference as single glazed windows are not a thing anymore.
    The report you got is yours and it’s an obvious typo but the actual cert makes no mention of it.

    The unit out the back.

    So you can give them back the A2W and they will install the solar to keep you happy :p

    Serious though, no there’s no breach at all. Part L compliance can be achieve in a couple of ways so the developer chose the better route for you in my opinion. A2W is substantially better than gas boilers IMHO.

    Perfect thanks. I was 10% wondering if I could chance my arm but 90% making sure nothing comes back to haunt me when selling in the future.

    The assessor did not include single glazed windows.

    this is a result of SEAI incompetence because of how the Advisory Report is generated.

    If you have an A3 rating on a new build its most likely the assessor used the exact make and manufacturer of the windows in order to input the exact tested u value.

    because of the stupid way the software is designed, if you input the exact make and manufacturer, the "window section" defaults to single glazed windows..... idiotic, but thats how they designed it.

    also note, the actual "BER Cert" doesn't refer to any of this..... the advisory report is separate and absolutely not worth the paper its written on. its automatically generated from the software, and a document that the assessor has no control over how its worded.
