No win no fee?

    Hi, my uncle is currently seeking medical expenses for an accident he had. He is dealing with a solicitor who has been looking into it for 12 months now (physio, medical reports, etc) The understanding was no win no fee, or no foal no fee. If his claim is unsuccessful does this mean he will not owe the solicitor anything? It seems odd that if this has been going on for a year that a solicitor will not get payment should the matter not work out for my uncle.

    It depends on the details of the agreement he has with the solicitor. While it may have been going on a year, has the solicitor done much work on it?

    Your uncle should bear in mind that any such agreement may well still expose him to costs involved in outlays, and he could still have the other parties costs awarded against him should he be unsuccessful in court.

    He should have gotten a written engagement letter from his solicitor at the outset. That's a key document.
