Could Ireland Use a US-style Small Claims Court System

    I've watched a couple of episodes of Judge Judy which happened to be on day time TV on Friday. Take away the TV element and the fact that technically this is arbitration, but the standard process of me a citizen being able to sue someone for something under 5k.

    Our small claims process is only for certain commercial contracts and doesn't cover torts as far as I understand it.

    I think it would be a positive step for Ireland to introduce such a process so that if my neighbor's kid breaks a window or I loan money to a friend who doesn't pay it back, or whatever. I suppose we'd need to bring in an enforcement process too.

    Anything is possible once you legislate for it and set up the processes involved and provide for all the related matters.

    Just on this point, many do not realise parents are not liable for the torts of minors save for an act directed by the parent.
