Amendment to planning

    Hi there, I wonder if anyone has come across a similar situation before.... My parents own a small bungalow on 30 acres. They applied for and received planning permission to demolish the house and build a new two storey house in its place. However, this was pre-covid and now circumstances have changed. They plan to sell the bungalow to me to live in if they can amend their own planning to move the house to a different location on the farm. Obviously this is a bit of a catch-22 as I cannot buy the bungalow until they know if they can amend their planning, but they will probably not get the planning amendment (which would include not demolishing the existing house) if they already own a house! Had anyone come across a similar situation before and know if there are any solutions? We all have local needs and have lived in the area for 30 years. I don't own a house myself.

    Appreciate any advice....

    That's not an "amendment" - it's a completely new planning application.

    Assuming you are happy with the service you got from the person who prepared the first application go back to them and they will advise you on the new application. The previous planning permission lasts five years so even if the new application fails the original one still exists until the five years are up.

    Agree with MT. Not an amendment.
    Full application required but now you have to deal with the 2 dwellings on the site.

    Is there a local needs criteria in your area? This is something you need to iron out with the planners before lodging as your parents may not be able to apply as they don’t have a housing need due to owning the existing house.

    And you may be caught from applying as normally a condition stops a sale for 7 years. Not sure if that condition is still popular though.
