My Son bought a Car from A.dealer with 3 months warranty There was no Spare wheel which dealer replaced with a normal wheel instead of smaller type it protrudes onto the boot. Water is getting into the boot The Engine light came on and he left the car back and they gave him a courtesy car with No NCT. If my Son is not Satisfied with repair can he demand his money Back.
He only has the car a week

Yes he does have the right to ask for his money back, but depending on the attitude of the dealer it might be a redundant endeavour.

How much did he pay for the car?

Your son will be getting 5 points on his licence if stopped by the guards in that car.

I'd say a lot depends on age and the price paid for the car..also just because a light came on in the car doesn't mean your son should get his money back..theres a clear process in which the garage will need to be allowed to rectify the fault to a satisfactory standard..he needs to be clear with them and keep a record of dates etc. Also I'm sure he could have rejected the full size spare wheel and requested a skinny one..this is a very small issue.
As for the courtesy car not having an nct..is the absolutely no nct disc on the windscreen or is it possibly out of date only a few months as theres currently a 3 month extension to all nct tests. Might even be 4 months for cars due to covid
So if car test expired the end of December 20.. that car would still be ok and legal at least up to end of March.
Main point which should have been given in your initial post op..
Type and age of car ./mileage and price he paid..
It could be bargain basement 1500 euro
Car over 10 years old with high mileage
Or has he spent around 10k for a much newer car in which anyone would expect it to be trouble free ..
    More details please op..

Wrong and unnecessary scaremongering, sort of like a tabloid.

    1. NCT certs have been extended, so it may still be in date officially

    2. If it's not got an NCT cert and should have one, It's at discretion of Garda whether to take car and prosecute.

    3. A successful prosecution results in UP TO 5 penalty points.

So if car is in good nick, and driver has decent reason for driving it, and does not come across as a dick, they probably will be allowed continue.

He cannot just ask for money back. See below link.

The dealer have three options - repair, replace or refund.

What year and brand is car?
    Other details?

You have two chances of getting a refund off a second hand dealer...slim and football association

The Car my son bought is a 2012 Mitsubishi Lancer paid €5000. for it. He now tells me the Dealer did not have registration Documents on hand but would sort it out Apparently they Forged my Sons signature as he has received the Documents in his name. The Car is now back with the dealer for repair.

Forged your son's signature for what purpose? Properly registered dealers can do the change of ownership online so don't need the new owner to sign the old log book to transfer ownership.

    ya that's fishy

and a 2012 Lancer for 5k? seems too cheap esp off a dealer

If you start throwing that kind of language around you will get nowhere with the dealer. As bazz, any legitimate dealer can change ownership without your son's signature.

We will wait to see what repairs Dealer Does. Thank all for replies

It would be a good idea I'm sure if you went along with your son when the car is repaired..I'm sure your son is capable of speaking also and should have at minimum properly inspected the car and requested the skinny wheel to be supplied..
But to be honest I think you're now throwing any possible excuse to blame this car dealer..
Also as per my previous post..is the courtesy car actually out of nct or not..
If it is completely out of test then your son had a responsibility equally to request another courtesy car..
Simply ensure you go back with your son when collecting car and ensure that the repairs are now lasting repairs and that the car is fit for the purpose your son bought it for..
Otherwise you'll just keep getting half arsed stories thrown in here and there from your son when anything even minuscule happens to that car..

Scaremongering?? Are you having a laugh? Have a look on the Garda twitter thread if you think people aren't being done for having no NCT. NCT certs were extended but OP has stated the car doesn't have a current NCT.

When you collect car check its dry inside then bring it straight to a car wash and check it does not now leak. Its unlikely dealer will hand you back the cash, particularly as car is driving.
