Management Fee change from equal share to Sq Feet

    Deeds of apartments in block state management fee is an equal share the development consists of 2 bed and 3 bed units some of which are larger size... currently we are all paying the same fee.
    Can this be changed to being based on SQ feet by vote at an EGM ? Can someone contest the change legally?

    Your contract is key here. If your contract with the OMC says that your free will be calculated in a certain way, it’s extremely hard to change that. A vote at an AGM cannot charge it unless 100% of the owners agree. There is a route through the high court to have contacts amended without all the owners agreeing but it’s for extremely unusual circumstances.

    The last poster is correct, such a change would require 100% support. We looked at making a similar change (from unit size to services received -shared entrance units get more services than own door or houses) but there was no way we could get 100% support so had to give up on the idea.

    The difference would be negligible. You'd have people saying that it should be number of people in a dwelling. Others saying room 3 is an office room etc etc.

    Unless it was a huge difference in size eg 700 sq ft v 1100sqft it's not really worth the bother.
