Do you know if the judicial review application is allowed, @nd notice of motion is served, and when it is at “for mention stage”- can time limit still become an issue?

Yes. Until the Statement of Opposition comes in, anything can be in issue. It may be that the Respondent will claim that the effective date of the decision was earlier than the date of the decision claimed in the Statement of Grounds and therefore the application for leave was made out of time. .
