Driveway Patio Question

I want to install a new front cobble lock driveway and a backyard patio.

I have had a few people out to quote but I have a question regarding their thoughts on the process.

One suggests digging out the front and the side entrance and back path (all concrete) and installing over the hardcore, membrane etc

The other suggests to dig out the front but not to dig out the concrete at the side entrance and the rear and to install over it with hardcore, membrane etc

    I’m confused.

The concrete at the back has some cracks and is displaced in certain areas i.e the footpath to the shed for example

Can anyone suggest the pros and cons of these options?
