Commencement Notice?

    Hi,
    Our commencement notice was submitted on Thursday morning but it is currently still incomplete. I'm just wondering how long does it take to be validated or is there something wrong with ours that it is yet to come through?

    Had an issue with this only this week.
    Technically, unless you are building an essential service building, your commencement notice, if all correct will be validated BUT, and thats a bit BUT, you cannot start works. The notice is only valid from between 14 to 28 days so unless the lockdown is lifted before day 28 from submission, your CN will run out so legally you will have to resubmit another one when things get going again.

    Yes ive a couple of them to send in for one off dwellings but figured it would technically be illegal to declare that someone is intending to start building within the lockdown so ive held off on them.

    The Building Control Authority have 7 days to validate the Notice.

    The BCA don’t have the power or remit to rule any project essential or not, that is the job of the Gardai and HSA under SI4 of 2021 so therefore the BCA should be validating your CN assuming all the details are correct.

    But, the new legislation makes no provision for the BCA to lengthen the time period for the CN, so as the lads a above mention, if you don’t start within 28 days then you need to lodge a new CN.

    The Gardai are actively checking sites here in Dublin.

    Thanks all, I thought the 28 days was from the commencement date and not the submission date, looks like we will be putting it in in a few weeks again then too! thanks

    Day 1 lodge giving 14 days notice

    Day 14 commence

    Day 28 you’ve either commenced or the notice expires.
