Are NDA's a thing here when discussing an idea with a solicitor?

    Sorry if this is a stupid question.


    I have a business idea which is fairly well planned / fleshed out.


    It's semi innovative.


    I'm going to look for a solicitor soon as I need some contracts drawn up that will be used between my company and partners that work with my company.


    It's not that I think the solicitor will run off and steal my idea, but more a worry that they might just chat casually about it to someone and it gets ripped off.


    Is that something I need to worry about, and if so is it fairly normal to ask them to sign a NDA?

    Any discussion with a legal representative is subject to lawyer/client privilege (the client's privilege) and is wholly confidential as well as being subject to privacy and GDPR laws. The duty of confidentiality around clients' business is something professionals take very seriously and would be subject to severe regulatory intervention/censure if it was breached.

    A solicitor who discusses a client's business around the town so to speak will not be in business for very long.

    If however you are not comforted by the extent of the professional duties not to mention the serious reputational damage a professional would do to themselves being loose-lipped with a client's business, you can of course ask anyone to sign anything you want that gives you comfort. Just don't be too surprised if they say it's completely unnecessary.

    I have intellectual property in my practice

    An idea is not something that attracts an NDA

    You have no asset or no demonstrable loss and the amount of times people have thought that they had a great idea that needs to be protected like the third secret of fatima is pretty common.

    Turn it into a business. An idea is worthless.
