Whats the time limit for Garda to recharge you after case was a strike out?

    So my case was a strike out because Gardaí didn't show up. It was a DUI but i think the charge was called driving whilst unfit to do so or something along them lines. This was my 5th court date relating to this charge. Solicitor said its possible they could recharge me. Is that common and whats the time limit for that?


    Just feels like the offence is hanging over me indefinitely, not knowing if the Gardaí are going to prosecute me or not.

    At what point and how does something get marked peremptory against the State? Bit of a hijack but tangentially related OP.

    2 and a half years is the accepted time period for District court proceedings.
