Conditions on planning

    I was was granted planning permission over a year ago, as part of the grant a number of conditions were attached.

    I submitted evidence of the conditions being met at the beginning of October.

    Now three months later I still not have heard back from the county council. I contacted them 4 weeks ago but was told that I would just have to wait until the relevant departments were ready.


    Has anyone experienced this? How long might this take? Can they just keep me waiting indefinitely? I know with planning application etc. there are set deadlines when they have to get back to you, it seems with this there is nothing of the sort and we just have to wait.

    Can you be more specific as to what conditions you are referring to? All conditions? Payment of contributions? Are works complete?

    You do need to elaborate.

    Building hasn’t begun yet, these conditinsons have to be met “prior to the lodgement of a commencement notice”

    Conditions include:
    Method/safety statement
    Schedule of materials and finishes
    Ecology report.

    Building hasn’t begun yet, these conditinsons have to be met “prior to the lodgement of a commencement notice”

    Conditions include:
    Method/safety statement
    Schedule of materials and finishes
    Ecology report.

    Generally it's a good idea to phrase the cover letter like "having fulfilled the enclosed conditions we intend to proceed with the planning approved ref ... And start construction in three months from date of letter unless otherwise instructed." Or something similar that allows you to proceed if they don't reply.

    I'd only do this for simple conditions that are a tick the box exercise that they may not bother replying to.

    Id agree with the above although I would tighten it up a little by stating that you intend submitting a commencement notice in 3 weeks and request confirmation of compliance with the specified conditions prior to the date of submission of said notice.

    Thanks for the solid advice, unfortunately I have already submitted the documents so can’t include a cover letter indicating a date to expect the commencement notice.

    Should I just submit the commencement notice and see what happens? Builder is ready to start in a few weeks...

    Still haven’t heard back and builder ready to start as soon as construction opens up again.

    The plan is just to submit my commencement notice and hope this doesn’t delay the project.
