Hi, My friend is working in a small call centre which operates 24/7 365 days a year. There are extra pay and time off perks to working bank holidays. This year St Stephen's Day is on a Saturday with the bank holiday the following Monday. Those working the 26th are being given none of the perks. This is really bad form at any time but after the year they have but in working all through Covid it's dreadful. I am wondering if the employer is correct to treat December 26th like any other Saturday?

    From work place relations

"When a person works on a public holiday they are entitled to be paid for the day in accordance with their agreed rates. In addition they also have an entitlement to benefit for the public holiday. This can be different for each public holiday and each employee depending on the individual's work pattern.

If the business is closed on the public holiday and an employee would normally be due to work then they get their normal day's pay.

If the business is open and an employee works, he/she is entitled to either paid time off or an additional day's pay. The additional day's pay is what was paid for the normal daily hours last worked before the public holiday. "

The person needs to look at their contract and what it says in relation to bank holidays

Scroll down to the heading public holidays falling on a weekend. The public holiday for 2020 is the Saturday, 26th Dec so normal public holiday entitlements apply. Monday 28th is not a public holiday, though many employees will treat it as one.

"Public holidays falling on a weekend -
If the public holiday falls on a day which is not a normal working day for that business (for example, on Saturday or Sunday) you are still entitled to benefit for that public holiday. This will apply in 2020 when St Stephen’s Day (26 December) will fall on a Saturday. Note that where a public holiday falls on a weekend, you do not have any automatic legal entitlement to have the next working day off work. This means that Monday 28 December 2020 is not a public holiday. "

    Centras /Supervalu staff
would get 1/5 there weekly average based off the past 5 weeks in regards to bank holidays, so you friend should get 1/5 there weekly average for both the 25 and 26th

That's in relation to part time staff where a bank holiday falls on a day they're not usually rostered. In those situations they're entitled to 1/5 of their normal working week. The OP's question is different.

That the bank holiday set up for SV/Centra for all staff Full and Part time.
as majority of the time you don't have fixed days / hours.
but it typical means you have the equivalent of an extra day pay/ day off if you do work full time hours.

but misread the OP post see he was referring to small call centre and not a small centra.
