Abusive from CEO

    I know I can't ask for legal advice per say.
    If a CEO was send a highly abusive and derogatory email to an employee, calling them horrendous names and telling them where to go in no uncertain terms, would this be a very clear cut legal case against the company?

    Is there such a thing as a clear cut legal case? If there was a history of repeated abuse or assaults to your dignity, you might have a case for bullying, if you were there for more than a year, you could have a case for unfair dismissal. Context is important.

    Strange for the CEO (or anyone) to send abusive emails like that and not realise that the emails could be saved / shared. Unfortunately you probably won't get much or any support internally against the CEO. Doesn't sound like a nice place to work. Do you like your job or would you leave?

    He's extremely reckless but this is the first time he's bang to rights in a documented communication and let himself slip too far. They don't even have a dedicated HR.

    It's not as simple as you think, an email can easily be faked and proving it is genuine requires access to
    mail servers and specialist IT skills, forensic skills that will be paid for by you.

    In saying all that, the threat of taking the email to an employment tribunal might be enough, but just be aware that an email on its own might not be enough.

    If you are only working there since March, the Unfair Dismissals Act may not apply, and the threshold to be met for a successful claim of bullying was raised by this case. You may indeed have him bang to rights, but it’s by no means gaurenteed.

    Make sure you go through the grievance process first, this will strengthen your case. You should be prepared for them to lay out the level of your supposed incompetence at any hearing.

    I find it very hard to believe a CEO is sending e-mails to staff calling them retards and to go **** themselves.

    However if you're really telling the truth and this isn't a wind up, you need to ask yourself what your goal is.

    Resign and then sue?

    Stop the abuse?

    Something else?

    What do you want?

    If it's "resign and then sue" then you need to talk to a solicitor and not trust advice from a bunch of strangers on boards (who likely are kids with social anxiety) as this is a complex issue.

    It has gotten really bad since I was last there, I regretted going back almost immediately once I saw how badly things have deteriorated and have been looking for work elsewhere all over the pandemic.

    Reminds me of the time I was sending an email and thankfully just before I sent it, noticed that I had signed off with "Retards" instead of the more passively aggressive "Regards".
