    Contributions apply to retention applications as normal.
    Usually with planning applications you get the first 40 square meters exempt, but part of the penalties of going the retention route is that you no longer benefit from that exemption.

    Section 10 (II)
    For clarification purposes;
    (a) Exemptions and reductions shall not apply to permissions for
    retention of development.

    Thanks very much, from what I read, this is my understanding too. I am however very surprised that after contacting 2 different Architects, when I was looking for quotes, none of them knew anything about these contributions being imposed.

    Our house extension that is at the rare of the house is less than 40 sq m. However there is an utility room (part of the extension) approx 8 sq m, that goes to the side of the house for which planning permission should have been obtained. Do you know if we will have to pay the development contribution only on that part of the extension that requires planning permission, or on the whole extension?

    Apply for retention for just the side bit and then pay the levy on the 8 Sq. M only :)

    *assuming you can get an opinion on compliance with the exempted development regulations fkr the portion to the rear.

    Sorry, the information I provided was not entirely correct, we are in a process of buying this house, so I had to look at the map agian. The kitchen was extended with approx 20 sq m, the extension is at the rare but it also goes to the side of the house (the bigger part is at the rare but there is also approx 8 sq m of that extension that goes to the side). In addition to that there is a utility room that goes completely to the side of the house (again approx 8 sq m). So when applying for permission, are we applying just for these 16 sq m that go to the side or do we apply for the whole extension that is 28 sq m?

    If you are buying this house, why are YOU taking on this problem and being out of pocket for it??

    we are currently in negotiations for price reduction because of this issue and therefore I am trying to figure out the total cost.

    I sold a house last year and the garage had been built separately from the house. The builder built it to what he thought were the regs - 40m2 but standalone garages are only 25m2 so we had to apply for retention.

    House could not be sold without it and it was our responsibility. We did agree to the sale but it was conditional on the retention being sought so conveyancing continued while the process was being completed.

    BTW, we did not pay a levy on this retention!

    If the extended elements are all connected then any at the rear will become de-exempted so you should apply for retention of the whole shebang.

    Base the price on retention for the whole lot then. And also opinion sim compliance with the retention. And the risk that retention is refused.

    Also will your bank release funds for a property that’s in planning breach?
