Returning to Work

    My Spouse is due to return to work next month.after her maternity leave and parental leave . She is on a recruitment process with another employer and may resign the current employer when she gets an offer letter.The Current employer says that she wont be eligible to get the Annual holiday hours accrued during maternity if she resigns from there.
    Is the employer rigt?
    Where can I enquire about this

    No they arent - holidays accrue and are an entitlement. Try citizens info. If she took the 16 weeks unpaid then she will also accrue 6.15 holidays (based on 20 day entitlement in the year) in addition to the 10 days for her 26 weeks leave. Also accrues for parental.

    From citizens info - Public holidays and annual leave

    In general, you are treated as being in employment while you are on maternity leave or additional maternity leave. This means you can continue to build up your entitlement to annual leave. You are also entitled to leave for any public holidays that occur during your maternity leave (including additional maternity leave).
