Drones footage of private gardens

Someone posted a drone video on a community Facebook page showing it filming a privately managed housing estate with visual footages of the residents' back gardens of houses.

Can anyone advise if this is a privacy breach?

Tried to ask the person to take down the video but with no luck.

An article on it here. https://www.irishexaminer.com/farming/arid-30895371.html

How is drone footage any different to images on Google satellite view?

It’s illegal to fly a drone in an urban area without specific permission from the IAA.

Drones are small, satellites are far away

Google satellite is blurry. You can hardly tell if someone has a shed in the back garden.

Drone footage can show you if the shed has a padlock.

Google's satellite images aren't satellite images at the zoomed in level they're taken from planes, and in some areas they're very detailed.

If the drone is under 1Kg and stays below 15m then most of the rules don't apply, just a broad don't cause a hazard. While a lot of drones are above 1kg there plenty that are below it now after the industry change with the new EU regs, and 15m is almost twice the average 2 story house so you're not exactly hugging the ground.

Not true. There are restrictions but it’s not a blanket ban on flying in urban areas at all!

Interesting. Presumably you can take videos and pictures in public spaces, even if private property can be seen. With drones tho they could be over a private property which would make it a tresspass. But if the drone was over a public road taking video coverage and you could see into private back gardens I am not sure what law has been broken.

The drone is flying over private roads.

Privately owned roads can still be classed as public spaces.

If I stand on as street and can photograph your garden - clearly no expectation of privacy in that garden.

Say that garden has an 8ft high hedge, I get a ladder and take photos into the garden? Probably infringing on your expectation of privacy now. Hard to see how the drone is any different.

Have you seen the quality of google maps these days? Hard to see how a satellite is any different?

    It's still not great.
Here's an image at max zoom on Google Maps. This is some street in NYC, probably the most photographed city in the world. The graphics in Grand Theft Auto 1 showed more detail than this view.
Hard to compare this to 4k drone footage a few dozen feet above your property.

you can also get stuff removed from google maps, street view is somewhat comparable but it is still a particular moment in time. a drone is right now and very controlable to see specific details
