Compatability of the law concerning forced "voluntary" data sharing.

    Sitting here deeply pondering a situation.

    So if somebody on social welfare gets referred to one of these jobpath schemes, where they are being referred to a private company like Seetec or Turas Nua who are contracted to assist people in getting a job, any job, so that the company can claim "success" payments.

    Reading the blurb about mandates and getting sustainable employment is all very well, but there are multiple reports about people being forced onto dead end schemes to massage the relevant national employment figures which have zero effect in helping a person gain rewarding and reasonable employment.

    What caught my attention is people are expected to engage in the interest of getting back to work. Good stuff, it is very much needed and desired. However, reading the small print it appears that if you do not "engage" you are sanctioned. Accordingly if you do engage, your data is automatically consented for distribution and they have right to send you data to whomever they "believe" is appropriate.

    I do believe that it is a required service, if you can call it a service, but you must have control over what can and cannot be distributed about you and to whom. An example would be "could an unemployed solicitor be touted by one of these agencies to a charity shop as a cashier on a dole scheme where you get an extra 20 euro a week for a year, that kind of thing. Not to mention at any telephone interview, (which you are "invited" to take - under risk of sanction for "not engaging" ) being asked deeply personal questions about a persons history " on the basis of assessing the person"

    This has not happened, but is a what if situation I am pondering.

    So, can you be forced to "voluntarily" provide information you are not comfortable providing for whatever reason (for example a medical issue or history, or personal hatred of something) As you will be accused on not engaging otherwise, and then be subject to sanction.
